The New e-Appeal: Frequently Asked Questions

  1. Why do we need a new e-Appeal?
    The current e-Appeal Online system, developed 20 years ago, is based on client-server applications and allows users to view just one case at a time. In the new e-Appeal, appellants and representatives will have a dashboard that allows them to manage in a single location all cases and case materials before MSPB.
  2. What is the e-Appeal go-live date?
    The new e-Appeal will be available for all users beginning on Monday, October 2, 2023.
  3. What is happening before the new e-Appeal go-live date?
    Leading up to and after the new e-Appeal go-live date, the following can be expected:
    • E-filing Unavailable: E-filing functionality in the current e-Appeal Online system will be unavailable after 11:59 p.m. EDT on Friday, September 8, 2023.
    • E-Appeal Repository Available: The current e-Appeal Repository will be available for parties to an appeal to view and download records through 5:00 p.m. EDT on Friday, September 29, 2023.
    • User Guides: Materials will be available in the e-Appeal Hub to help prepare users to navigate the new e-Appeal.
    • After Go-Live: All the functionality users need to file and monitor appeals successfully will be available in the new e-Appeal.
    • Case Processing Suspended: Appeals processing at the regional/field office and headquarters levels will be suspended temporarily to permit the transition to the new e-Appeal.
    • All filing and processing deadlines that fall from Saturday, September 9, 2023, through Friday, October 6, 2023, will be extended by 28 calendar days. Because of an unscheduled outage of the current e-Appeal Online system on Friday, September 8, 2023, all filing and processing deadlines that fell on Friday, September 8, 2023, are now extended to Tuesday, October 10, 2023.
      • This extension applies to all deadlines before MSPB, including those at the initial appeal and petition for review levels.
      • The extension is automatic, so parties will not be required to request it or show good cause for an extension.
      • This automatic extension does not apply, however, to any deadlines that pass before Friday, September 8, 2023, or to deadlines that fall on or after Saturday, October 7, 2023.
      • The Office of Special Counsel is advised to contact MSPB in the event it intends to file a new stay request during the transition period (Saturday, September 9, 2023, through Friday, October 6, 2023).
      • Filing time limits of external reviewing authorities (e.g., Federal courts and the Equal Employment Opportunity Commission) are not extended.
  4. How can I get information on how to use the new e-Appeal?
    Refer to the e-Appeal Information Hub on the MSPB website for the latest information about the new e-Appeal.
  5. How will I access the new e-Appeal?
    To access the new e-Appeal for the first time, you will create an account with a new username and password. The new e-Appeal will be available beginning on October 2, 2023, at https://e-appeal.mspb.gov.
  6. What will happen to my case record when the new e-Appeal goes live?
    Your case record—which you currently view through the e-Appeal Online Repository—will be migrated to the new e-Appeal, along with your contact information. All e-Filers will need to create a new e-Appeal user account to access their case(s).
  7. How will the new e-Appeal affect appellants?
    Appellants will have a more streamlined user experience with the new e-Appeal, as they will be able to file pleadings and view the case record from the same location on their new e-Appeal dashboard. Also, if appellants have more than one case with MSPB, they will be able to view all cases from the dashboard.
  8. How will the new e-Appeal affect appellant representatives?
    Appellant representatives can view all cases where they serve as the designated appellant representative from a single location on their e-Appeal dashboard.
  9. How will the new e-Appeal affect agency representatives?
    Agency representatives can view all cases where they serve as the designated agency representative from a single location on their e-Appeal dashboard. Before the new e-Appeal go-live date, MSPB will provide information about new processes for agency users who serve as the initial contact for notification of new appeals. Information will also be provided regarding new capabilities for agency units to manage their users.

    Agencies should review pending cases prior to the new e-Appeal go-live date to ensure that all agency representative designations are accurate.

  10. What else do I need to know? MSPB recognizes that the current e-Appeal Online system is heavily relied upon by our external users—appellants, appellant representatives, and agency representatives—to file appeals and pleadings and receive notifications of MSPB issuances. MSPB is cognizant that the transition may be disruptive and inconvenient; however, we are confident that stakeholders will be excited by the enhanced capabilities offered by the new e-Appeal once the transition is complete.
